Hi Lynn: Just wanted you to know that I looked up the IRS 2007 rules myself. As I understand it, Ye who provides more than 50% of support during the tax year is supposed to be able to claim them.
I have found out that "Mother" claimed at least 2 of the children. So, I went to the IRS website, entered "fraud" into the seach, and filled out Form 3949A. It will go out in tomorrow's mail.
Unfortunately, we did not get our taxes filed yet. We always have a refund so no biggie. When we do file, I am certain we will be red-flagged because we will claim the 4 kids. They have lived with us since 04-17-07.
I plan to report this info to the Court next week. I have already informed DCS. To them, its just another "event" in the long line of events they've had to deal with "Mother".
I can hardly wait for termination . . . . so that we can move on with our own lives without all the drama and entanglements.

I'm glad you were able to find what you needed. It will be a good day for you when all of this is behind you. The 'waiting' is the worst part it seems. Let us know when it's all done so we can celebrate that day with you! I have to ask. You did file for an extension?

There are lots of rules and yes's and no's you need to answer, such as.....can anyone else claim them on their return. Here is an IRS link for you to look at. You will see other links here for the publications. Dependents/Exemptions Once you have gone through this and if you have any questions or just want to talk over the possibilities come back and we'll see what we can do.

I did not see anything about the rules for dependents. The Department of Child Services (DCS) got "technical" custody of them in October, but the kids continue to stay with me. They are leaning on terminating mom's rights to them. Also, all the kids are "Special Needs" children, but are not blind or deaf. Ug, I just got a call yesterday from DCS indicating mom wants to see them. She has not seen them since Aug. I hate what the kids have to go through when this starts up again.

hello moonshotter, in order to claim the children you must have legal documentation stating that you are there legal guardian . alond with there birthday and social security number. also they must have lived with you all of the preivious year. you may also be elegable for (EIC) Earned Income Created depending on how much money you made in 2007. the most you can have made for a married couple is $35,000 I think.hope this information has helped. Hi I did some looking through some various publications at the IRS website and I have come to the conclusion that you have so many variables at work here that we need to approach this in a different way. If you do not have a tax accountant or are not going to file your taxes through a tax agency, then I suggest you call the IRS directly, at 1-800-829-1040. They will be asking you questions pertinent to your situation to help them assist you. And that information is best given to them, not me. Pretty much all I can do for you is to point you in the right direction. But I am curious to have you come back and let me know how your phone call went and what they were able to tell you, if you are willing to share that.

Okay, I'll go through it tomorrow and I'll leave a post here for you with some questions that I need answered. With that information, I should be able to point you to the correct answer at the IRS website. So sorry all this is happening, for you and especially for the children, hopefully it makes everyone stronger. I'm really wondering if they are going to allow her to see them if they have been leaning towards this decision, but one never knows. You do have your hands full don't you.

The law is reunification until about 18 months. My grandson will be 1 in April so been almost 1 year. Extremely tough. Never in my wildest dreams did I think this could happen.
