Okay... just got my bill, which I don't usually open since it automatically comes out of my checking account... but there was an interesting piece of paper in there...
Well, you know how hard it is to get out of a contract, and one of the few ways to do so is if they change something in your contract that you didn't sign up for like a price change... well here's what this slip of paper reads:
Important Information on New Messaging Rates
Beginning on August 29, 2008, the charge to send or receive domestic messages will be 20¢ per message (plus tax). The price change applies to messages you send or receive while you are in the US, Canada, or Puerto Rico, including messages you send to or receive from international numbers while in those locations. If you subscribe to a monthly messaging bundle, the price for the bundle is not changing, and this rate change will apply only to messages in excess of your monthly allotment.
Messages include text, instant, e-mail, picture, video, and other multimedia messages. International roaming charges and rates continue to apply when you are traveling outside of the U.S., Canada, or Puerto Rico. This rate change does not apply to Take Control or KidConnect plans. You can continue to send and receive messages without incurring per-message charges if you have a plan or feature that includes unlimited messages of that type. See www.my.t-mobile.com/messagerates for more information on the rate change and section 3 - 5 of T-Mobile's Terms and Conditions, available at T-Mobile.com, for additional information on your rights (which may include early service cancellation) as a T-Mobile customer. NOW, section 5 of the Terms and Conditions states (as listed at t-mobile.com):
5. Our Rights to Make Changes. Your Service is subject to our business policies, practices, and procedures, which we can change without notice. UNLESS EXPRESSLY PROHIBITED BY LAW, WE CAN CHANGE PRICES, CHARGES AND ANY TERMS IN THE AGREEMENT AT ANY TIME. IF WE MATERIALLY MODIFY THESE T&Cs IN A WAY THAT IS MATERIALLY ADVERSE TO YOU, OR IF A CHANGE INCREASES YOUR SET MONTHLY RECURRING CHARGE(S) (the set amount – which does not include overage, features, optional services, taxes and fees – you agreed to pay each month for at least a one-year Term), WE WILL PROVIDE YOU WITH AT LEAST 30 DAYS NOTICE AND YOU MAY TERMINATE YOUR SERVICE WITHOUT AN EARLY TERMINATION FEE (WHICH IS YOUR ONLY REMEDY) BY NOTIFYING US WITHIN 30 DAYS AFTER YOU RECEIVE THE NOTICE. IF YOU FAIL TO TERMINATE WITHIN THOSE 30 DAYS, YOU ACCEPT THE CHANGES.
So since this is a 5¢ increase, you should be able to call up and get out of your contract with no ETF. But after doing a little bit of research, I'm seeing it mentioned around the Internet that you can't get out if you have a messaging bundle... I don't know why that would mean anything unless you've got the unlimited bundle, since if you go over, you're still getting hit with the increase, but I dunno... You can try... I'm also assuming that if they say that you can't since you have a bundle, then you could always try cancelling your Message Bundle and THEN getting out of your contract... does that make sense?? Don't hold me to that, it's just my logic, which fails on occasion...
I just wanted to put that out there for those of you who don't pay attention to what comes in your bill, or if you don't log on to your t-mobile.com account regularly... I'd try and get outta mine, but I just got an awesome new phone from them that I'm in love with... well that and I have the unlimited text so it doesn't affect me anyway...
